These Terms of Service ("Terms") govern access to and use of Anaptiq's website at anaptiq.com and our missed-call text-back, follow-up, and booking service (the "Service"). By signing up for a trial, creating an account, or using the Service, you agree to these Terms on behalf of yourself and the business you represent ("you," "Client").
Anaptiq provides an automated system that, when a Client misses an incoming call, texts the caller back within seconds; follows up on open leads and estimates; helps book and remind customers of appointments; requests reviews; supports database-reactivation outreach to a Client's past customers; and gives the Client a dashboard and periodic reports of this activity. The Service is offered in multiple tiers (currently Patch, System, and Pro); current features and pricing for each tier are shown at signup and may be updated from time to time.
The Service is offered to businesses, not consumers. You must be at least 18, and by signing up you represent that you are authorized to bind the business you're signing up on behalf of. You are responsible for the accuracy of the information you provide and for activity on your account.
We offer a 14-day free trial of the text-back feature. No credit card is required to start a trial, and nothing is charged automatically when the trial ends. One trial per business. We may change or end the trial offer at any time.
If you continue past your trial, plans are billed month-to-month with no long-term contract, and you may cancel at any time, effective at the end of the current billing period. A one-time setup fee may apply outside of trial promotions; current fees are shown at signup. Payment for paid plans is arranged separately (for example, a secure payment link or invoice) after your onboarding call. Fees already paid are non-refundable except where required by law.
Because the Service sends automated text messages to people who call or text your connected business number — and, for reactivation campaigns, to your own past customers — you are solely responsible for having the legal right to contact those numbers, including compliance with the Telephone Consumer Protection Act (TCPA), CAN-SPAM, state telemarketing laws, and carrier requirements. You will not use the Service to contact numbers you do not have the right to contact, and you will honor opt-out requests. You agree to indemnify Anaptiq against claims arising from contacts you direct the Service to message.
You will not use the Service for unlawful, harassing, fraudulent, or deceptive messaging, to send content you don't have the rights to, or in any way that violates a third party's rights or applicable law. We may suspend or terminate accounts that violate this section.
When you cancel, we will provide a full export of your contacts and conversation history collected through the Service, consistent with what is described in our Privacy Policy, and will delete or anonymize your data from our active systems within a reasonable period after export, except where we must retain records for legal or tax purposes.
Anaptiq owns the Service, its software, and all related intellectual property. You own the content and business data you provide us. We may use anonymized, aggregated data (not identifying you or your customers) to improve the Service.
The Service is provided "as is" and "as available." We do not guarantee the Service will be uninterrupted, error-free, or produce any particular business result (such as a specific number of bookings or recovered leads). To the extent permitted by law, we disclaim all other warranties, express or implied.
To the extent permitted by law, Anaptiq's total liability for any claim arising from these Terms or the Service is limited to the fees you paid us in the 3 months before the claim arose, and Anaptiq is not liable for indirect, incidental, or consequential damages.
Either party may terminate for any reason with notice, effective at the end of the current billing period. We may suspend or terminate immediately for a violation of Section 6 or 7, or for non-payment.
These Terms are governed by the laws of the State of Washington State without regard to conflict of law principles, and any dispute will be resolved in the courts located in that state. We may update these Terms from time to time; the "Last Updated" date above reflects the most recent revision, and continued use of the Service after changes are posted constitutes acceptance.
